Clancy disabled the pollution control software on at least 13 diesel trucks operated by his company Clancy Logistics.

The software prevents a truck from running if it detects the pollution control hardware isn't functioning, so this allowed Clancy to then to disable that hardware.

Both Clancy and Clancy Logistics were charged. Both pleaded guilty to reduced charges. Both were pardoned.

Diesel Freak.- owned by Ryan Lalone - was charged with reprogramming the emission control systems of hundreds of heavy-duty diesel engines.

This violates the Clean Air Act. While this improves fuel economy and reduces maintenance costs, it also greatly increases emissions of toxic gases.

Lalone estimated that this practice made up 70 percent of Diesel Freak's business.

Elite Diesel Inc. is owned by diesel mechanic Troy Lake. In 2024, Lake was charged with instructing company employees to disable emissions control hardware on more than 325 heavy-duty commercial trucks from 2017 through 2020. This violated the Clean Air Act - which prohibits tampering with the devices.

According to a Department of Justice press release, tampering on these trucks "caused an illegal increase in pollutants" of at least:

Diesel exhaust is a known carcinogen and causes lung cancer. It also is associated with asthma and an increased risk of death from cardiovascular and respiratory disease. These effects disproportionately occur in low-income communities near highways and high-traffic areas, the press release states.

The pardon was prompted in part by a letter from Wyoming House Speaker Chip Neiman. It was issued in the name of the company, which also applies to Lake.
